Beginning January 1, 2020, the Occupational Safety and Health Administration (OSHA) regulations require companies with reportable violations to electronically submit incident information annually on Form 300A (Summary of Work-Related Injuries and Illnesses) and include their Employer Identification Number (EIN).
However, large employers of more than 250 employees may not be required to electronically submit Form 300 (Log of Work-Related Injuries and Illnesses) and Form 301 (Injury and Illness Incident Report). The agency intends this change to protect worker’s personal data from being publicly disclosed under the Freedom of Information Act (FOIA). OSHA still requires the employer to maintain the Form 300 and 301 on-site, and will continue to obtain these forms as needed through inspections and enforcement actions.
The rule’s requirement for employers to submit their EIN electronically is expected to make the data more useful for OSHA and the Bureau of Labor Statistics. It also could reduce duplicate reporting burdens on employers in the future.
