Last week, the U.S. Environmental Protection Agency (EPA) sent a reminder to all facilities that report toxic releases to the agency.  In particular, EPA wanted to reiterate to facilities selling products containing specific toxic chemicals of their obligation to annually notify their down-line customers of the chemical’s presence in those products. The exact chemicals targeted by the agency are the 767 listed on the Toxics Release Inventory (TRI) of the Emergency Planning and Community Right-to-Know Act (EPCRA) as well as those falling under an additional 33 chemical categories.  EPA noted that the annual “supplier notifications” would help the customers identify possible dangers in products that are included in mixtures or trade named products as they move through the supply chain.  Additionally, this notification alerts customers of their potential TRI reporting obligations. EPA’s message contained detailed information on the criteria a facility needs to meet to be subject to this requirement and a list of the items that must be included in the supplier notification.
