The U.S. EPA has become aware of submitter confusion and issues regarding confidential business information claims businesses made during an original reporting period for the Toxic Substances Control Act (TSCA) Active-Inactive Rule that closed in October 2018. Consequently, the agency acted last week to enable companies to submit, amend, or withdraw filings under the rule.  EPA will place a notice in the Federal Register soon.  Thirty days after the notice, reporting will re-open for 60 days. The original rule allowed TSCA reporting facilities to designate their chemicals as either “active” or “inactive” in U.S. commerce. Businesses reported this status for each chemical manufactured, imported, or processed over the 10-year period from 2006 through 2016. In May 2020, EPA posted an interim list of chemicals expected to lose their confidential business information status and move to the public portion of the TSCA Inventory. This is when EPA discovered the confusion in the original report and decided to reopen the reporting period.
